Mentor Law Director explains the decision to settle the wrongful death lawsuit

The News-Herald is reporting that Dian Sabo -- the widow of Richard Sabo, who was fatally shot by a Mentor police officer -- will receive $175,000 in the settlement of her wrongful death lawsuit. However, neither the city nor Sabo will confirm the amount, citing confidentiality. The News-Herald also quoted Sabo as saying she didn't settle. When asked about it, Sabo clarified that she meant the process was not finalized and likely would not be until after the holidays. Sabo confirmed that both sides have come to a settlement that they agree upon. Additionally, the case lawsuit has been dismissed from U.S. District Judge James S. Gwin's court. After a year of motions, dismissals and appeals, a jury trial to decide the Richard Sabo lawsuit is scheduled to begin Dec. 19 in the Northern District of Ohio's U.S. Federal Court. The suit is filed against Mentor Police Sgt. Scott Tkach who fatally shot Sabo during a brief standoff Feb. 5, 2009. Sabo had been acting unusually that afternoon, so his family called for paramedics to come to his house on Roselawn Drive. However, when paramedics arrived, Sabo would not cooperate with them. Paramedics claimed Sabo mentioned getting a gun, so they evacuated the house and took his wife, Dian Sabo, with them as a safety precaution. Police responded to the scene, including Tkach. The U.S. Court of Appeals for the Sixth Circuit has ruled against Mentor Police Sgt. Scott Tkach's appeal in a previous court decision that denied him immunity in a pending lawsuit from the widow of Richard Sabo. This means Dian Sabo's lawsuit against Tkach could now proceed to trial. The city of Mentor could also try to appeal the decision to the entire circuit court or the U.S. Supreme Court. I think the wife should be paying the city for all the costs they incurred in dealing with this ridiculous lawsuit. Bottom line is if your stupid enough to come out of your house with a gun and confront the police, it's not going to be a good day for you. Some advice to save the taxpayers some money, next time someone in your house is acting nutty and is playing with a gun, DON'T CALL THE POLICE.   more ›
