Alexander Ochaba was ordered to pay for the medical and funeral expenses of Sylvia Iwaszko, who he struck with his motorcycle last year
Alexander Ochaba was ordered to pay $291,768.10 in restitution to the family of Sylvia Iwaszko, according to The News-Herald. Ochaba, 25, of Mentor, ran into 76-year-old Iwaszko with his motorcycle while she was walking along Mentor Avenue and the ensuing injuries killed her. Lake County Common Pleas Judge Eugene Lucci ordered Ochaba to pay for Iwaszko's medical and funeral costs. In December, a jury convicted Ochaba of vehicular manslaughter, reckless operation, operating without reasonable control and speeding. Lucci sentenced Ochaba to 90 days in jail -- the longest jail sentence he could give him. Lucci also placed Ochaba on probation and suspended his license for three years. Alexander Ochaba was led from the Lake County Court of Common Pleas in handcuffs Friday morning. However, because of the jury's decision, he was able to avoid what could have been a much longer sentence behind bars. After a week-long trial, including a full day of deliberating, the jury decided that Ochaba, 25, of Mentor, was not guilty of aggravated vehicular homicide. Instead, they convicted him of vehicular manslaughter, as well as a trio of traffic crimes -- reckless operation, operating without reasonable control and speeding. The difference between vehicular homicide and manslaughter is whether or not the jury believed Ochaba engaged in reckless behavior that he should have reasonably known to be a threat to others. Alexander Ochaba testified Wednesday morning during his aggravated vehicular homicide trial. Ochaba, 25, of Mentor, was driving his motorcycle when he lost control of it while driving east on Mentor Avenue in Willoughby near Andrews-Osborne Academy. Both he and his motorcycle went off the road onto the sidewalk and his bike hit 76-year-old Sylvia Iwaszko in the back of her legs. The impact threw her more than 80 feet and knocked one of her shoes across a 4-lane highway, Willoughby Police Lt. Blaine Sweitzer testified. Ochaba was also thrown more than 200 feet when his motorcycle hit the curb. The crash happened on the evening of Aug. 23, 2011. The trial for a Mentor man accused of causing the death of a 76-year-old woman began Monday. Alexander Ochaba, 25, was driving his motorcycle when he lost control of it on Aug. 23, 2011 while driving east on Mentor Avenue in Willoughby near Andrews-Osborne Academy and the border with Mentor. Both he and his motorcycle went off the road onto the sidewalk and his bike hit Sylvia Iwaszko in the back of her legs. She suffered a fractured wrist, arm and vertebrae. Surgeons also had to amputate one of her legs. She died seven days later at MetroHealth Medical Center in Cleveland.
