The officer smelled marijuana and asked the driver to step out of the car. The policeman then saw Hurd, the passenger, moving furtively so he asked Hurd to leave the car also, Marjernik said.

The officer searched beneath Hurd's car seat and found a loaded .38 handgun, Majernik said.

Hurd is not legally allowed to have a handgun for two reasons.

One, he is out on bond in an aggravated robbery case that is pending in Lake County Court of Common Pleas.

Two, Hurd is already a convicted felon. In 2007, he was convicted of a theft that also involved a gun. He was sentenced to four years in prison but released after two.

Hurd was released on bond but then went on the lam when he was supposed to appear later that month in .

Coincidentally, he was found in Aurora, Co, a city that drew the nation's attention after a heavily armed man entered a movie theater 11 days ago and opened fire.

He killed at least 12 people and injured 50 others. The attack occurred during midnight screenings of the new Batman film "The Dark Knight Rises."

Hurd is not thought to have had any involvement in the shooting.
