Woman Accused of Driving Drunk With Child In The Car... Again

Tomeka Stockwell already pleaded guilty to driving drunk with a child in the car in June

A woman is accused of driving drunk with a child in the car -- .

Tomeka Stockwell, 26, of Painesville, was arrested shortly before midnight Monday. An officer spotted her car while it was parked on the side of Route 2 between the Route 306 and 615 exits, Mentor Police Lt. Tom Powers said. The car had a flat tire.

The officer suspected Stockwell of driving drunk. She failed field sobriety tests and refused to use the breathalyzer, Powers said.

She also had a 4-year-old child in the front seat. He was wearing a seatbelt but wasn't in a booster seat, which is required by law, Powers said.

Stockwell is charged with driving drunk, child endangering, driving with a suspended license, failing to properly restrain her child in the car and not wearing a seatbelt.

She was arraigned Tuesday morning in . She pleaded not guilty and Judge John Trebets set her bond at $17,500, which she did not post. Her next court appearance is scheduled for Oct. 24.

Stockwell was driving without a legal license because it was suspended the last time she was convicted of driving while intoxicated.

. At the time, she had her 3-year-old son in the car and was eight months pregnant.

Police charged Stockwell with operating a vehicle while intoxicated, child endangering, having an open container and driving between marked lanes.

She pleaded no contest and was convicted of driving drunk and having an open container in court. The other charges were dismissed.

When Trebets sentenced her, he ordered her to pay a $675 fine.

Trebets also sentenced her to 90 days in jail but suspended the punishment if she stayed out of legal trouble while on probation and completed a three-day driver's intervention program.

When previously asked about Stockwell's sentence, Trebets noted it was Stockwell's first drunk driving conviction and she received the sentence he normally gives first-time offenders.
